Cyber Rookie Terms and Conditions

Cyber Rookie is a division of Hyplon Pty Ltd (ABN 45 668 305 075) (Hyplon), offering online coaching, mentorship, practical skills development, and simulated work experiences in cybersecurity and governance, risk and compliance (GRC). These terms govern your use of the Cyber Rookie website and participation in our coaching programs.

1. Definitions

In these terms:

  • "ACL" means the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth)

  • "Services" means all coaching, mentorship, training materials, and related services provided by Cyber Rookie

  • "Subscription" means recurring access to Services on a monthly or other periodic basis

  • "Major Failure" has the meaning given in the Australian Consumer Law

  • "You" or "your" means the individual or entity enrolling in or using the Services

  • "We", "us", or "our" means Hyplon Pty Ltd trading as Cyber Rookie

  • Membership” means ongoing access to Services on a subscription basis.

2. Eligibility and Program Access

By enrolling, you confirm that you:

  • Are at least 18 years old.

  • Are not using the program for unlawful purposes.

  • Understand this is a coaching and mentorship service and not an offer of employment or certification.

  • Have the technical requirements necessary to participate (stable internet, compatible device).

This is an ongoing skills development membership and not a vocational training course, qualification, or accredited education program.

3. Services Provided

Cyber Rookie offers:

  • Access to coaching resources, exercises, and practical materials.

  • Live and recorded coaching sessions and masterclasses.

  • One-on-one mentoring, portfolio review services, and monthly team capability sessions as part of the Cyber Rookie Skills Lab membership.

  • Access to simulated Governance, Risk, & Compliance (GRC) security & privacy work environments.

  • Community forums and peer interaction opportunities.

We reserve the right to modify, update, or withdraw services at our discretion with reasonable notice. Access may be revoked immediately for misconduct, misuse, or breach of these terms.

4. Fees and Payments

  • All prices are listed in AUD unless otherwise stated.

  • Subscription fees are payable in advance and will auto-renew at each billing cycle unless cancelled at least 48 hours before the next billing date. You may select monthly billing and may cancel at any time through your account settings or by emailing team@cyberrookie.ai.

  • Auto-Renewal Disclosure: If you subscribe to recurring services, your subscription will automatically renew at the end of each billing period unless you cancel at least 48 hours before renewal. You will be charged the then-current subscription rate. You will receive an email reminder at least 7 days before each renewal date.

  • Payments are processed securely via third-party platform.

  • Late or failed payments may result in access suspension. We will notify you within 48 hours of a failed payment and provide 7 days to update payment details before suspending access.

  • We may update subscription fees with 30 days written notice. You may cancel before the next billing cycle if you do not agree to the revised fees.

5. Refunds and Cancellations

Refund Policy:

  • Within first 30 days of initial enrollment: Full refund of subscription fees paid, regardless of usage. This applies only to your first subscription period.

  • After 30 days from initial enrollment: No refund for the current billing period. You retain access until the end of that billing period.

  • One-on-one sessions: No refunds for completed individual coaching sessions or downloaded materials.

  • Major failure under Australian Consumer Law: Full refund where services have a major failure that cannot be remedied, or where we fail to remedy within a reasonable time.

  • Pro-rata refunds: Available at our discretion where we discontinue a service or feature that formed a substantial part of your subscription.

  • Refunds will not be provided for change of mind occurring after the initial 30-day period, except where required by the Australian Consumer Law.

How to Request a Refund:

Submit requests in writing to team@cyberrookie.ai with your account details and reason for refund. Refunds are processed within 14 business days to your original payment method.

Your Rights Under Australian Consumer Law:

Nothing in this refund policy limits your rights under the Australian Consumer Law, including your right to a refund or replacement for major failures, or compensation for other reasonably foreseeable loss or damage.

Cancellation: You may cancel your subscription at any time through your account settings or by emailing team@cyberrookie.ai. Your access to Cyber Rookie Skills Lab will continue until the end of your current billing period.

6. Intellectual Property

  • All Cyber Rookie content (including templates, videos, AI tool outputs, and coaching materials) is owned by Hyplon Pty Ltd.

  • You receive a limited, non-exclusive license to use materials for personal educational purposes only.

  • You must not reproduce, resell, distribute, or publicly share materials without express written permission.

  • Portfolio Exception: You may include work samples created during the program in your professional portfolio, provided you do not share proprietary methodologies or templates.

  • AI-assisted outputs provided during coaching sessions or workshops may not be relied upon as professional advice and must be reviewed with human judgement.

7. Conduct and Participation

You agree to:

  • Treat coaches, staff, and other participants respectfully.

  • Not engage in harassment, abuse, discrimination, or disruptive behaviour.

  • Use program materials for lawful, non-commercial purposes only.

  • Not attempt to record, copy, or distribute live sessions without permission.

  • Maintain confidentiality of other participants' personal information.

  • Participants must not disclose confidential business information shared during sessions, whether by Cyber Rookie, other participants, or employers.

Recording and Consent:

Some live sessions may be recorded for quality assurance, training purposes, and to provide catch-up access to participants.

Your Consent Options:

  • At the beginning of each session that will be recorded, you will receive clear notice that recording is taking place.

  • By remaining in a recorded session after this notice, you consent to being recorded for that specific session.

  • You may opt out by:

    • Leaving the session before recording begins

    • Participating with your camera and microphone turned off

    • Requesting a non-recorded alternative session where reasonably available

  • You may withdraw consent for use of recordings containing you by emailing team@cyberrookie.ai.

Use of Recordings:

Recordings may be used for internal training, quality improvement, and providing catch-up access to enrolled participants. Recordings will not be used for marketing purposes without your separate express consent.

8. Australian Consumer Law Compliance

Important: Nothing in these terms excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law that cannot be excluded, restricted, or modified.

Consumer Guarantees Under Australian Consumer Law: Our services come with consumer guarantees under the Australian Consumer Law that cannot be excluded, restricted, or modified by these Terms.

Your Rights Include:

  • Services provided with acceptable quality, fit for purpose, and delivered with due care and skill

  • A remedy (refund, replacement, or compensation) if services have a major failure

  • Compensation for any other reasonably foreseeable loss or damage resulting from a failure to meet consumer guarantees

What is a Major Failure?

A major failure occurs if:

  • The services are substantially unfit for their common purpose and cannot easily be remedied

  • You would not have acquired the services if you had known about the problem

  • The services are substantially different from what we described or displayed

Important: Nothing in these Terms (including our liability limitations, disclaimers, or refund policies) excludes, restricts, or modifies your rights under the Australian Consumer Law.

9. Disclaimer and Limitation of Liability

Service Disclaimers:

Cyber Rookie provides coaching and mentorship services only. We do not guarantee:

  • Employment, job placement, or recruitment outcomes

  • Pass rates for any certification exams

  • Specific career advancement or salary results

  • Continuous, uninterrupted service access (though we will use reasonable efforts to maintain availability)

Coaching, mentoring and capability support do not constitute legal, financial, compliance, or risk advisory services. You should obtain professional advice before relying on any information for compliance or audit purposes.

Limitation of Liability:

To the maximum extent permitted by law (and subject to the express exceptions below), we are not liable for:

  • Any indirect, consequential, or special damages

  • Loss of profits, data, opportunities, or goodwill

  • Actions you take based on program content or coaching advice

  • Third-party platform failures or technical issues beyond our reasonable control

Exceptions - We Do Not Limit Liability For:

  1. Death or personal injury caused by our negligence

  2. Fraud or fraudulent misrepresentation

  3. Breaches of consumer guarantees under the Australian Consumer Law

  4. Misleading or deceptive conduct under the Australian Consumer Law

  5. Any other liability that cannot be excluded or limited by law

Liability Cap (where permitted by law):

For claims where we are permitted to limit liability, our total liability is capped at the amount you paid for the specific service in the 12 months preceding the claim.

Your Responsibility:

You are responsible for ensuring the services meet your specific needs before purchasing. We recommend reviewing all available information and asking questions before enrolling.

10. Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:

  • Internet service provider failures.

  • Third-party platform outages.

  • Natural disasters or government actions.

  • Technical failures of essential systems.

In such cases, we will use reasonable efforts to restore service and may extend access or provide reasonable alternative arrangements depending on the nature of the disruption.

11. Privacy and Data Protection

We handle your personal information in accordance with our Privacy Policy. By enrolling, you consent to the collection and use of your information as outlined in our Privacy Policy.

12. Modifications to Terms

We may update these Terms with 30 days notice via email or website notification. Continued use of services after the effective date constitutes acceptance of modified terms. If you do not agree to modifications, you may cancel your subscription or enrolment.

13. Termination

Termination by You:

You may cancel your enrolment at any time subject to Section 4 (Refunds and Cancellations).

For business memberships, the organisation is responsible for managing user access and notifying us of staff departures or seat transfers.

Termination by Us:

We may suspend or terminate your access for:

  • Material breach of these Terms after providing you 7 days written notice to remedy (except for serious breaches as outlined below)

  • Serious breaches including: fraudulent activity, illegal use, severe harassment, or threats to other participants (immediate termination)

  • Non-payment after 14 days written notice

Refund on Our Termination:

If we terminate for our convenience (not due to your breach), you will receive a pro-rata refund for unused services.

If we terminate due to your breach, no refund will be provided, except where required by the Australian Consumer Law.

Effect of Termination:

Upon termination, your access ceases immediately or at the end of your billing period (depending on circumstances). You lose access to all materials except:

  • Work samples you created for your portfolio (as permitted in Section 5)

  • Certificates of completion already issued

14. Governing Law and Disputes

These Terms are governed by the laws of Victoria, Australia. Any disputes will be handled by courts in Victoria.

Alternative Dispute Resolution: Before commencing legal proceedings, we encourage resolution through direct negotiation or mediation.

Mediation will be conducted in the state of Victoria, Australia unless otherwise agreed.

15. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Team/Business Terms

For business subscriptions providing seats for multiple staff members, the subscriber (your organisation) remains liable for payment of all seats. Hyplon Pty Ltd reserves the right to adjust pricing for additional seats or tier upgrades. Access and deliverables for business subscribers may differ from individual subscriptions as detailed in the subscription agreement.

The Services are educational and capability-building in nature and do not constitute professional consulting, legal advice, or compliance services. Any review of internal documents is limited to capability development and general guidance.

17. Access Termination & Data

On termination (by you or us), your access will cease at the end of your current billing period. We may retain certain data in accordance with our Privacy Policy and applicable law; you may request deletion of your personal data, however learning portfolio materials may be retained for internal records.
