Cyber Rookie Terms and Conditions
Effective Date: 10 July 2025
Cyber Rookie is a division of Hyplon Pty Ltd (ABN 45 668 305 075) (Hyplon), offering online coaching, mentorship, and simulated work experiences in cybersecurity and GRC (Governance, Risk & Compliance). These terms govern your use of the Cyber Rookie website and participation in our coaching programs.
1. Eligibility and Program Access
By enrolling, you confirm that you:
Are at least 18 years old.
Are not using the program for unlawful purposes.
Understand this is a coaching and mentorship service and not an offer of employment or certification.
Have the technical requirements necessary to participate (stable internet, compatible device).
2. Services Provided
Cyber Rookie offers:
Access to coaching resources, exercises, and practical materials.
Live and recorded coaching sessions and masterclasses.
One-on-one mentoring and portfolio review services (additional service offering to the Cyber Rookie Accelerator program).
Access to simulated Governance, Risk, & Compliance (GRC) security & privacy work environments.
Community forums and peer interaction opportunities.
We reserve the right to modify, update, or withdraw services at our discretion with reasonable notice. Access may be revoked immediately for misconduct, misuse, or breach of these terms.
3. Fees and Payments
All prices are listed in AUD unless otherwise stated.
Subscription or program fees must be paid in full or as per an agreed payment plan.
Payments are processed securely via third-party platforms.
Auto-Renewal Disclosure: If you subscribe to recurring services, your subscription will automatically renew at the end of each billing period unless cancelled at least 48 hours before renewal. You will be charged the then-current subscription rate.
Late or failed payments may result in access suspension after 7 days notice.
4. Refunds and Cancellations
Refund Policy:
30-day satisfaction guarantee: Full refund available within 30 days of enrolment.
Pro-rata refunds: For unused portions of subscriptions when cancelled with 30 days notice.
Major failure refunds: Full refund where services have a major failure under Australian Consumer Law.
Refund requests must be submitted in writing to info@cyberrookie.ai.
Refunds processed within 14 business days to the original payment method used.
No refunds for completed one-on-one sessions or downloaded materials.
Cancellation: You may cancel recurring subscriptions at any time through your account settings or by emailing info@cyberrookie.ai.
5. Intellectual Property
All Cyber Rookie content (including templates, videos, AI tool outputs, and coaching materials) is owned by Hyplon Pty Ltd.
You receive a limited, non-exclusive license to use materials for personal educational purposes only.
You must not reproduce, resell, distribute, or publicly share materials without express written permission.
Portfolio Exception: You may include work samples created during the program in your professional portfolio, provided you do not share proprietary methodologies or templates.
6. Conduct and Participation
You agree to:
Treat coaches, staff, and other participants respectfully.
Not engage in harassment, abuse, discrimination, or disruptive behaviour.
Use program materials for lawful, non-commercial purposes only.
Not attempt to record, copy, or distribute live sessions without permission.
Maintain confidentiality of other participants' personal information.
Recording and Consent:
Live sessions may be recorded for quality assurance and training purposes.
By participating in live sessions, you consent at the time of enrolment to recording and potential use for internal training.
You will be notified when recording is taking place.
You may request to participate with camera/audio off if preferred.
We reserve the right to remove access without refund for behaviour that violates these terms.
7. Australian Consumer Law Compliance
Important: Nothing in these terms excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law that cannot be excluded, restricted, or modified.
Consumer Guarantees: Our services come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
8. Disclaimer and Limitation of Liability
Service Disclaimers: Cyber Rookie provides coaching services only. We do not guarantee:
Employment or job placement outcomes.
Pass rates for certification exams.
Specific career advancement results.
Continuous, uninterrupted service access.
Limitation of Liability: To the maximum extent permitted by law, we are not liable for:
Any indirect, consequential, or special damages.
Loss of profits, data, or job and business opportunities.
Actions you take based on program content or advice.
Third-party platform failures or technical issues.
Total Liability Cap: Our total liability for any claim is limited to the amount you paid for the specific service giving rise to the claim.
9. Force Majeure
We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:
Internet service provider failures.
Third-party platform outages.
Natural disasters or government actions.
Technical failures of essential systems.
In such cases, we will use reasonable efforts to restore service and may extend program access period for one month as compensation.
10. Privacy and Data Protection
We handle your personal information in accordance with our Privacy Policy. By enrolling, you consent to the collection and use of your information as outlined in our Privacy Policy.
11. Modifications to Terms
We may update these Terms with 30 days notice via email or website notification. Continued use of services after the effective date constitutes acceptance of modified terms. If you do not agree to modifications, you may cancel your subscription or enrolment.
12. Termination
By You: You may terminate your enrolment at any time subject to our refund policy.
By Us: We may terminate your access immediately for:
Breach of these terms.
Fraudulent or illegal activity.
Disruptive behaviour affecting other participants.
Non-payment after reasonable notice.
13. Governing Law and Disputes
These Terms are governed by the laws of Victoria, Australia. Any disputes will be handled by courts in Victoria.
Alternative Dispute Resolution: Before commencing legal proceedings, we encourage resolution through direct negotiation or mediation.
14. Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
